1. Acceptance of Terms

By accessing or using Nevernote ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Nevernote is a zero-knowledge, end-to-end encrypted note-taking application. Your notes are encrypted on your device before being stored on our servers. We cannot read, access, or decrypt your notes.

3. User Accounts

You may sign in using third-party authentication providers (Google, Microsoft, or Apple). You are responsible for:

• Maintaining the security of your authentication credentials
• Remembering your encryption passphrase - we cannot recover it
• All activities that occur under your account

4. Encryption & Data Security

Your data is encrypted using your personal passphrase before it leaves your browser. Important points:

• We never have access to your unencrypted data
• Your passphrase is never transmitted to our servers
• If you forget your passphrase, your data cannot be recovered
• You are solely responsible for backing up your passphrase

5. Acceptable Use

You agree not to use the Service to:

• Store or transmit illegal content
• Violate any applicable laws or regulations
• Attempt to circumvent security measures
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission

6. AI Features

The Service may offer optional AI-powered features (summarization, transcription, etc.). These features:

• Use your own API keys from third-party AI providers
• Process data on your device or through your chosen AI provider
• Are subject to the terms and privacy policies of those AI providers
• Are entirely optional and not required to use the core Service

7. Data Storage

You may choose to store your encrypted data on our servers or on your own Google Drive. We are not responsible for data stored on third-party services.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided "as is" without warranties of any kind.

9. Limitation of Liability

To the maximum extent permitted by law, Nevernote shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, even if we have been advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time for violations of these terms. You may delete your account and all associated data at any time through the Settings menu.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
